OPINION

BLISS, Judge.

The appellant, Lirean L. Kimble, hereinafter referred to as defendant, was charged, tried by jury and convicted in the District Court, Tulsa County, Case No. CRF-75-2567, with the offense of Manslaughter in the First Degree, in violation of 21 O.S. 1971, § 711. His punishment was fixed at five (5) years' imprisonment to be served in the State penitentiary. From said judgment and sentence the defendant has perfected a timely appeal...
