The opinion formerly delivered in this cause on November 23, 1976, is withdrawn and the following is substituted therefor.

This is a trespass to try title case. Luvenia Allsbrook Pete, appellee (plaintiff), brought suit against C. R. Newland, the predecessor in title of appellant (defendant), Mahlon L. Walters. The suit was commenced in 1962 and Newland conveyed the land to Walters in 1970. Walters and Pete both filed motions for summary judgment...
