Defendant was indicted for selling cocaine, a Schedule II controlled substance (§ 195.020, RSMo Supp. 1971). The jury before whom defendant was tried found him guilty but was unable to agree upon the assessment of punishment. Accordingly, the trial court assessed defendant's punishment at twenty years confinement in the Department of Corrections of the State of Missouri (§ 195.200, RSMo Supp. 1971).
