Plaintiff-appellant Keith R. Antz, brings this appeal from the trial court order dismissing plaintiff's complaint. Plaintiff initiated this action against the City of Jeffersonville (Jeffersonville) to gain reinstatement with and back pay from the Jeffersonville Fire Department. On April 14, 1976, the trial court entered the following judgment dismissing plaintiff's complaint:
