The issues presented in this civil appeal will be addressed following a statement of the facts.

On the 7th of October, 1969, a truck driven by James Davis (appellee herein) and owned by Arctic Motor Freight overturned on a highway near Fairbanks, Alaska, injuring Mr. Tracy McCracken, a passenger in the truck. On November 19, 1969, Tracy McCracken and his wife, Audrey L. McCracken (appellant herein), filed a civil complaint...
