Plaintiff Samet & Wells, Inc. ("Samet & Wells") brought this action for infringement of its copyright on a stuffed toy turtle against Shalom Toy Co., Inc. ("Shalom") and its president Martin Weber, seeking an injunction against continued infringement, damages and an accounting for profits resulting from the alleged infringement.1
