In a trial before a jury, appellant was convicted of theft of services. See V.T.C.A. Penal Code, Sec. 31.04(a)(1). Punishment was assessed at a fine of twenty-five dollars.

The record reflects that in the evening of November 29, 1975, appellant and his wife went to the Balinese Room in Galveston, incurred a bill of $28.75 for beverages ordered and consumed by them there, and...
