HOOD, Judge.

Mr. and Mrs. Olin Travis Megason claim damages for injuries sustained by Mrs. Megason when a laparotomy pad was left in her abdominal cavity following surgery. The suit was instituted against the hospital, the chief surgeon, the assisting surgeon, and their insurers. Plaintiffs settled their claims against the hospital and the chief surgeon prior to trial, and the suit was tried only on their claim against the assisting
