GUILD, Justice.

In a jury trial the defendant was found guilty of involuntary manslaughter (Ill.Rev. Stat.1971, ch. 38, § 9-3(a)) and was sentenced to serve 1 year to 1 year and 1 day in the Illinois State Penitentiary. On January 7, 1977, subsequent to the conviction of the defendant but prior to oral argument in this court, the defendant was pardoned by the Governor of the State of Illinois,

". . . of the said crime of involuntary manslaughter . ....
