On July 19, 1973, defendant-appellant Curtis Burhannon was charged by affidavit with the crime of possession of a narcotic drug, to-wit: heroin, in violation of IC 1971, 35-24-1-20(c), Ind. Annot. Stat. § 10-3538(c), (Burns Supp. 1973). Following trial by jury Burhannon was found guilty as charged, ordered committed to the Indiana Department of Correction for a period of not less than two nor more than ten years and...
