This is an appeal from a judgment which granted a Bill of Review and set aside a former judgment. Jimmie Woodard, d/b/a Tu J Refrigeration, hereinafter referred to as "Woodard," filed suit on sworn account against Hopperstad Builders, Inc., hereinafter called "Hopperstad," in the District Court of Cameron County, Texas, on March 29, 1971.
