The plaintiff corporation filed this action against defendant, a surveyor, for damages for negligence in performing a survey. As an affirmative defense, the defendant alleged that plaintiff's cause was barred by the two-year statute of limitations contained in ORS 12.135.1 By agreement of the parties, the question of whether plaintiff's cause was barred by ORS 12.135 was submitted to the trial court as a preliminary matter...
