BLISS, Judge:

Appellant James Charles Abbott, hereinafter referred to as defendant, was charged in the District Court, McClain County, Case No. CRF-74-117, with the crime of Larceny of an Automobile, in violation of 21 O.S. 1971, § 1720. The case was tried before a jury, and defendant was convicted. Punishment was assessed at five (5) years' imprisonment. From said judgment and sentence a timely appeal...
