Defendant Chase Manhattan Bank, N.A., ("Chase") moves for an order pursuant to Rule 12(b)(1), Federal Rules Civil Procedure dismissing Count VI of plaintiff's complaint on the ground that this Court lacks subject matter jurisdiction.
