RAPER, Justice.

John W. Butcher, legatee, renounced the bequest to him under the will of the testatrix following the filing of the executor's final account and petition for distribution. The district court declared the renunciation to be of no force and effect and ordered the executor to proceed as though no renunciation had been filed.
