OPINION

ROBERTS, Judge.

This is an appeal from a conviction for felony theft under our new Penal Code. Punishment was assessed by the court at five years, probated.

Appellant's sole ground of error reads as follows:

"The Court erred in overruling Defendant's Exceptions to the Indictment in violation of the Sixth and Fourteenth Amendments to the Constitution of the United States of America, Article I, Section 10, of the Constitution of Texas...
