This is an appeal by the defendant-appellant, Carlos Rutherford, from a judgment of conviction entered by the circuit court of the City of St. Louis. The appellant was found guilty by a jury of the offense of tampering with a motor vehicle, § 560.175 RSMo 1969 and the court, under the Second Offender Act, sentenced him to the department of corrections for a term of four years. § 556.280 RSMo 1969.
