Plaintiff brought this declaratory judgment action after its property was specially assessed by defendant's city council for a portion of the costs of improving a street upon which the property abuts. Defendant appeals from the trial court judgment declaring the assessment of plaintiff's property invalid and ordering defendant to refund payments made by plaintiff thereunder.
