The appellant was indicted and convicted for assault with intent to ravish. The trial judge sentenced him to twenty years imprisonment.

On Sunday morning, January 23, 1977, Minor Sims, an employee of Partlow State Hospital, saw the appellant, also an employee, lying on top of a patient on the floor of the recreation room in the hospital.
