Defendant was convicted of discharging a firearm into an occupied building and assault with a deadly weapon, inflicting serious injury. He was sentenced to two consecutive ten-year terms. Evidence was adduced at trial tending to show that on the night of 27 July 1975 defendant waited outside the Charcoal Tavern in Fayetteville, anticipating a confrontation with one Yarborough, whose car he thought he saw outside.
