The Appellees, Hermit and Geneva Grigsby, filed their complaint in the Knott Circuit Court on May 30, 1973, claiming damages in the amount of $20,000.00 against the Kentucky Oak Mining Company for causing and allowing great quantities of earth, rock and other debris to slide down, upon and over the land of the Appellees.
