OPINION

RABINOWITZ, Justice.

In November of 1973 appellant Harold Harvey Joe was indicted for the crime of assault with a dangerous weapon. The gist of the indictment was that Harvey Joe and Lawrence Kompkoff unlawfully and feloniously assaulted William Hansen by stabbing him, being thus in violation of AS 11.15.220. On September 4, 1974, Joe entered a plea of nolo contendere to the charge of assault with a dangerous weapon.1
