This appeal involves two problems which arose in a prosecution of defendant Charles Calvin Jackson for assault with intent to commit murder.

The jury could find from the evidence that on the evening of June 12, 1976, Brenda Beechum went to the races with defendant and then went to defendant's apartment shortly after midnight.
