This is a medical malpractice case. Plaintiff, Silvestre Mata, sued defendant, Dr. Richard O. Albert, a general surgeon, alleging he was injured as a result of defendant's negligent acts in performing disc surgery and a lumbar spinal fusion on plaintiff.
