We respectfully dissent. An analysis of the undisputed facts compels the conclusion that the injury to the claimant herein arose out of and in the course of his employment. He was a taxi driver who was on duty during working hours when the events in question occurred. He became involved in an argument with a fare in front of the Americana Hotel in New York City...
