OPINION

BUSSEY, Judge.

Appellant, Danny Lee Grizzle, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County, Case No. CRF-73-2426, for the offense of Murder in the Second Degree. From a judgment and sentence of ten (10) years to life imprisonment in the State Penitentiary, defendant perfects this timely appeal.
