This is an original proceeding in which we issued a rule to show cause. The matter is now at issue, and we make the rule absolute.

The petitioner was the defendant in a civil action tried by the respondent court on February 9 and 10, 1977. At the conclusion of the trial the respondent judge took the matter under advisement, and on March 2nd entered findings, conclusions and judgment in favor of the plaintiff and against the petitioner.
