This is a post conviction habeas corpus proceeding under Art. 11.07, V.A.C.C.P., seeking petitioner's release from a conviction and five year sentence on December 5, 1973, in the 199th Judicial District Court of Collin County, Texas, for the offense of sale of heroin, which was affirmed by this Court in a per curiam opinion, No. 49,293, decided January 22, 1975.
