Defendants' motion to dismiss the complaint under CPLR 3211 (subd [a], par 5) on the ground that the cause of action may not be maintained because of the Statute of Frauds was properly granted — the letter of January 31, 1963, the only paper-writing submitted on the motion, does not evidence an agreement enforceable against the individual defendants...
