This is an appeal from an order overruling the defendant's plea of privilege.

Plaintiff, Keith E. Cook, instituted suit in the District Court of Duval County, Texas, alleging that the defendant's servants, agents and employees negligently caused a truck to collide with a herd of cattle owned by the plaintiff, resulting in the death of one cow and injury of another.
