The petitioner is currently on parole under a 15-year sentence imposed on November 15, 1972, following his conviction in a jury trial for bank robbery (Criminal Action 72-34). He has filed this action alleging that his constitutional rights were violated when the prosecutor used the petitioner's "pretrial silence" to impeach petitioner's testimony at his trial.
