The sole issue of this appeal concerns the legality of the amendment, in the absence of his counsel, of the original sentence imposed upon the defendant.

The defendant was charged with perjury, La.R.S. 14:123, arising out of his testimony at his trial for another offense. On February 10, 1975, with the assistance of his counsel, he pleaded guilty to the perjury charge and was sentenced to three years...
