MEMORANDUM OPINION

WADDY, District Judge.

In this action plaintiff, David R. Merrill, charges the defendant, Federal Open Market Committee, with violating the Freedom of Information Act (FOIA), 5 U.S.C. § 552, by refusing to promptly make available certain of its records. The case is before the Court upon plaintiff's motion for summary judgment and defendant's cross-motion for summary judgment.
