JAMES, J.

In two counts of an amended information, the State charged that defendant Jubie unlawfully and feloniously "delivered" controlled substances "as proscribed by RCW 69.50.401." A third count charged that he "wilfully, unlawfully and feloniously did sell for profit a controlled substance, to-wit: LSD, as proscribed by RCW 69.50.401." Jubie waived his right to a jury trial.
