After his arrest on July 1, 1975, the defendant was indicted by the Grand Jury of Schenectady County in an indictment charging violations of subdivisions 2 and 3 of section 1192 of the Vehicle and Traffic Law. After plea bargaining, the defendant ultimately pled guilty to reckless driving and driving while his ability was impaired.
