The plaintiffs commenced this action for declaratory and injunctive relief with respect to a determination of the defendant which denied reimbursement of their litigation expenses under the State's Medicaid and Blue Cross programs, changing a policy in effect prior to February, 1975. Plaintiffs allege that the present policy denying such reimbursement is inconsistent with article 28 of the Public Health Law and the regulations promulgated thereunder, that litigation expenses...
