OPINION

MANDERINO, Justice.

Appellant, Henry B. Miller, entered a plea of guilty to an indictment charging him with the May 4, 1978, murder of his mother, Mariella Miller. Following a degree of guilt hearing at which both the prosecution and appellant presented testimony, a court en banc set the degree of guilt at murder in the first degree. Appellant was sentenced to life imprisonment and this appeal followed.<...
