In this appeal defendant challenges his conviction of murdering Michael Servey in violation of § 690.1, The Code. The case arose from events which have become familiar because they have been the subject of testimony in this and two other prosecutions. In State v. Nowlin, 244 N.W.2d 596 (Iowa 1976) (filed simultaneously herewith) we affirmed defendant's conviction of murdering Maureen Connolly. In
