On March 3, 1972, an indictment was returned charging Arthur Moore and Leroy Chalmers with the offenses of armed robbery and aggravated battery. At a preliminary hearing, Moore and Chalmers presented oral motions to quash their arrests and to suppress evidence and the trial court ordered that these motions be denied.
