OPINION

MASSEY, Chief Justice.

July 23, 1976 a jury in County Court found (1) Patrick Henry Hollifield to be a mentally ill person and (2) that he required hospitalization in a mental hospital for his own welfare and protection or the protection of others. Both findings were made by "a preponderance of the evidence." There was no objection to the Charge of the Court. There was no motion for new trial. Mr. Hollifield was immediately confined, for observation...
