OPINION

The petitioner, Nolen W. Russell, was indicted for the murder of his wife, Mary Shelton Russell. On the trial, the jury found petitioner guilty of murder in the second degree and fixed his sentence at not less than ten nor more than twenty years in the state penitentiary.
