Subsequently, pursuant to section 20 of the Lien Law, this lien was discharged by defendants' payment of $303 including interest to the date of deposit to the Sullivan County Clerk, and, as a result, there remained in effect only a lien against the deposited funds. Seeking the foreclosure of this remaining lien, plaintiff later served a summons and complaint upon defendants, who responded by moving to dismiss the complaint and vacate a lis pendens filed at the commencement...
