In May, 1976, defendant, Thomas Sidney Ard, was indicted for three counts of mail fraud under 18 U.S.C. § 1341 by the United States Grand Jury for the Southern District of Alabama. At Ard's arraignment on June 3, 1976, he entered a plea of not guilty to all three counts in the indictment. On July 7, 1976, upon a jury finding Ard guilty of all three counts, the United States District Court for the Southern District of Alabama sentenced Ard under 18...
