MEMORANDUM AND ORDER

EDWARD R. BECKER, District Judge.

This memorandum explains our dismissal without a hearing of the defendant Emanuel Brown's second motion under Fed.R. Crim.P. 33 for a new trial on the grounds of newly discovered evidence. As was the first, this motion is based on a purported recantation by the defendant's younger brother, Calvin Brown, a key witness against him at the jury trial for bank robbery at which he was convicted.
