OPINION

JAMES, Justice.

This is a summary judgment case. The trial court granted a summary judgment in favor of Defendant-Appellee Republic National Bank, Trustee for TI Employees Universal Profit Sharing Trust (hereinafter called "the Trust") by holding that Plaintiff-Appellant Edward E. Macaruso take nothing, from which Macaruso appeals. We reverse and remand.
