PETTY v. STATE

No. 49086.

332 So.2d 413 (1976)

Sarah Heflin PETTY v. STATE of Mississippi.

Supreme Court of Mississippi.

May 25, 1976.

Attorney(s) appearing for the Case

McKee, McDowell & McAlpin, Starkville, for appellant.

A.F. Summer, Atty. Gen., by Wayne Snuggs, Sp. Asst. Atty. Gen., Jackson, for appellee.

Before PATTERSON, ROBERTSON and BROOM, JJ.

BROOM, Justice, for the Court:

Manslaughter conviction (upon an indictment charging her with the murder of her husband) and a twenty year penitentiary sentence resulted from appellant's (Petty's) trial in the Circuit Court of Oktibbeha County. We affirm.

Appellant argues that: (1) State's Instruction No. 3 was error; (2) the lower court should have applied the Weathersby Rule; and (3) the verdict was against the overwhelming weight of the evidence.
