OPINION

CAFFREY, Chief Judge.

This is a civil action in the nature of a complaint to quiet title to a parcel of real estate located on Martha's Vineyard in West Tisbury, Massachusetts. Jurisdiction of this court is based on diversity of citizenship and the claim that the amount in controversy exceeds $10,000. Defendant's answer puts in issue whether the amount in controversy does, in fact, exceed $10,000.
