MAUGHAN, Justice:

On appeal is a judgment of the district court dismissing plaintiffs' (hereafter Hansen) complaint against defendants (hereafter Kohler) and awarding a money judgment in favor of intervening defendants and cross-claimants (hereafter Pierce) against Hansen.
