On the 26th day of December, 1970, Edward Schultz, while walking across a public street, was struck and killed by an automobile. The driver did not stop at the scene of the accident and his identity is unknown.

In February, 1972, the petitioner was appointed administratrix of the estate and now, five years after the date of death and more than two years after her appointment, she brings this proceeding pursuant to subdivision...
