Jackie Oglesby was convicted of perjury under Tit. 14, § 377, in Talladega Circuit Court and sentenced to five years' imprisonment. The Court of Criminal Appeals affirmed. We granted certiorari on the ground that the opinion of the Court of Criminal Appeals was in conflict with prior decisions of both this Court and the Court of Criminal Appeals.
